geckotool GmbH, in the following called “geckotool
First offer:
The presentation of the products in the online shop is not a legally binding offer, but an invitation to place an order. Performance descriptions in catalogues as well as on the websites of geckotool do not have the character of an assurance or guarantee. The offer can change at any time.
2. prices:
The prices are in Swiss Francs (CHF), including VAT and transaction fees (e.g. from paypal, post or credit cards). The shipping price is charged separately and depends on the location of the delivery address
3. conclusion of contract
The contract comes into force with the acceptance of the order by geckotool
4. delivery and shipping:
Delivery and shipping takes place as soon as the goods are in possession of geckotool. If not specifically noted, the goods will be shipped within 5 working days if the products are in stock. Information about delays in delivery will be communicated by geckotool to the customer.
5. retention of title:
Until full payment has been received the delivered goods remain the property of geckotool.
6. payment:
Payment is made directly with the order via the payment portal. The customer can choose from the available payment methods within the framework and before completion of the order process. If third party providers are commissioned with the payment processing, e.g. Paypal, Postfinance, etc. their general terms and conditions apply. Unless otherwise noted, the fees incurred will be paid by geckotool.
7. availability of goods:
At the time of the creation of the terms and conditions geckotool has no products in stock, because we are only in the process of building an assortment. The purchased products will be shipped in mid-December at the earliest, respectively when they arrive at geckotool’s headquarters.
8. return:
A return is only possible if the goods show no signs of use. Geckotool accepts a return of the goods within 10 days without giving reasons. The article must be unused and in perfect condition. We will refund the purchase amount minus the expenses incurred for shipping & packaging and the fees for the respective payment platforms e.g. PayPal, credit cards, Postfinance, etc.
The customer shall bear the costs incurred for the return shipment.
9. defects/exchange:
You as a buyer are obliged to check the goods after receipt and to report defects in writing to me within 5 days (thomas@geckotool.com).
It is my concern that you are happy with my products!
If you are not satisfied, you can send the goods back to me within 10 days without giving reasons. I will refund the purchase amount minus the expenses for shipping & handling and the fees for the respective payment platforms e.g. PayPal, credit cards, Postfinance, etc. The customer shall bear the costs incurred for the return shipment.
10. guarantee:
The warranty is determined by legal regulations.
A guarantee exists for the goods delivered by the seller only if this was expressly given.
11. liability:
The liability is determined by legal regulations of Swiss law.
12. place of jurisdiction/applicable law/contractual language:
The place of jurisdiction is the location of the seller (geckotool GmbH). At the time of the creation of the GTCs and without express change, the place of jurisdiction is Winterthur, Canton of Zurich, Switzerland.
Swiss law applies. Contract language is German, unless otherwise agreed at the request of the customer and with the consent of geckotool GmbH.
13. data protection:
The regulations of the “Data protection for the website” apply.
14. severability clause:
If a provision of this contract or contents of an enclosure of this contract integrated in the contract is or becomes invalid, the validity of the contract in all other respects is not affected. The contracting parties shall replace the invalid provision by a valid provision which comes as close as possible to the intended economic purpose of the invalid provision and the originally agreed contractual balance. The same shall also apply to any contractual loopholes.
