We are therefore responsible for the collection, processing and use of your personal data on our website. Your trust is important to us – and also your data security. We observe the legal provisions of the Federal Data Protection Act (DSG), the Ordinance to the Federal Data Protection Act (VDSG), the Telecommunications Act (FMG) as well as other data protection regulations,
for example the Basic Data Protection Regulation of the European Union (hereinafter DSGVO).

We are therefore pleased to inform you in the following about how we handle your personal data. Please note that the following statements may be adapted from time to time. We therefore recommend that you consult this data protection declaration regularly.

1 Basic information on data processing and legal basis

This privacy policy informs you about the nature, scope and purpose of the processing of personal data in connection with the functionalities of our website and the services offered on it. The privacy policy applies regardless of the domains, systems, platforms and devices (e.g. desktop or mobile) used to run the online service.

The personal data processed within the framework of our websites and online offers include inventory data (e.g., names and addresses of customers), contract data (e.g., services used, names of companies and persons), usage data (e.g., the websites of our online offer visited, interest in our services) and content data (e.g., entries in the contact form or comments).

The term “user” covers all categories of persons affected by the data processing. They include our business partners, customers, interested parties and other visitors to our websites and their online offers.

We process your personal data only in compliance with the relevant data protection regulations. This means that your data will only be processed if we have a legal permission. This means, in particular, if the data processing is necessary for the provision of our contractual services (e.g. processing of orders) and online services, or is required by law, or if consent has been granted, as well as on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation and security of our online services, in particular in the measurement of reach, the creation of profiles for advertising and marketing purposes).
marketing purposes as well as the collection of access data and use of the services of third parties.

2 Security measures

We use technical and organizational security measures in accordance with recognized market standards to protect personal data stored with us against unintentional, illegal or unauthorized manipulation, deletion, modification, access, disclosure or use and against partial or complete loss.

Our website geckotool.com is operated on servers of the hosting provider XXX. These are located in certified and secured data centers. The connection to the servers is made using 256-bit SSL encryption (recognizable by the URL that begins with “https” and the green mark in the address line of your browser).

We also take the company’s internal data protection seriously. Our employees and the service companies we commission have been obligated by us to maintain confidentiality and to comply with data protection regulations.

3 Passing on of data to third parties and third-party providers

We will only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from a contractual relationship. We may also pass on your personal data if this is based on justified interests in the economic and effective operation of our business.

In addition, we will pass on your data to external service providers if this is necessary for the execution of the contract. These service providers use your data exclusively for order processing and not for any other purposes.

We will never sell your personal data to third parties.

If, in the context of this data protection declaration, content, tools or other means are used by other providers (hereinafter jointly referred to as “third party providers”) and their named headquarters are located in a third country (i.e. not in Switzerland), it must be assumed that a data transfer to the headquarters of the third party providers will take place. The transfer of data to third countries takes place either if an appropriate level of data protection, user consent or other legal permission is available.

For certain services, we work together with specialized companies (for example, to operate our e-mail newsletter). For this purpose, we transfer personal data in order to operate this service. Here we take suitable legal precautions as well as appropriate technical and organisational measures to ensure the protection of personal data in accordance with the relevant legal regulations.

7 Additional integration of third party services and content

We use content or service offers from third parties within our websites for the analysis, optimisation and economic operation of our online offer in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as “content”). This always presupposes that the third party providers of these contents are aware of the IP address of the users, as without the IP address they would not be able to send the contents to their browsers. The IP address is therefore necessary for the display of this content. We make every effort to use only such content whose respective providers use the IP address only to deliver the content. We like to use videos on our website. Videos are a good way to transport content better and make it more understandable. Since a local hosting of videos is not powerful enough, we use the possibility of external video providers. For our own videos we mainly use Vimeo and from time to time YouTube. In addition, we occasionally include other videos from external sites. Third party providers are also used here. Due to the integration of the videos, it comes – for technical reasons – to calls of the servers of the providers such as Vimeo. For the associated use of your browser or terminal device data, we refer to the respective data protection information of the provider. You can find Vimeo’s data protection information here: https://vimeo.com/privacy

Social Sharing Plugins

FacebookOn our blog we use the “share” function in the form of the social plugin of Facebook. This is an offer from the US company Facebook Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA).

When you visit a page of our blog that contains such a plugin, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser, which integrates it into the website.

Through the integration of the plugin, Facebook receives the information that your browser has called up the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can assign your visit to our website directly to your Facebook account. If you interact with the plugins, for example by clicking the “Share” button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and your
Facebook friends.

Facebook may use this information for the purposes of advertising, market research and the design of Facebook pages in line with requirements. For this purpose, Facebook creates usage, interest and relationship profiles, e.g. to evaluate your use of our website with regard to the advertisements displayed on Facebook, to inform other Facebook users about your activities on our website and to provide other services associated with the use of Facebook.

If you do not want Facebook to assign the data collected via our website to your Facebook account, you must log out of Facebook before visiting our website.

For the purpose and scope of data collection and the further processing and use of data by Facebook, as well as your rights in this regard and setting options for protecting your privacy, please refer to Facebook’s data protection information.

LinkedInOur blog uses functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Each time you access one of our pages that contains LinkedIn features, a connection is established to LinkedIn’s servers. LinkedIn is notified that you have visited our sites using your IP address. If you click the LinkedIn “Recommend” button and are logged into your LinkedIn account, LinkedIn is able to track your visit to our site to you and your account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or of the data you have entered.

8 Newsletter

With the following information, we will inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedure and your rights of objection. By subscribing to our newsletters, you agree to receive them and to the procedures described and you consent to us processing your personal data for advertising measures, e.g. for sending e-mails of an advertising nature (newsletter).

Content of the newsletter

We send newsletters, e-mails and other electronic notifications containing commercial information (hereinafter referred to as “newsletters”) only with the consent of the recipients or a legal permission. When registering for the newsletter, the expected content is described in concrete terms and is decisive for the user’s consent. In addition, our newsletters contain information about our offers and promotions, our company and current news from the digital marketing industry.

Double-Opt-In and logging

The registration to our newsletter is done in a so-called double opt-in procedure. This means that you will receive an e-mail after registration in which you are asked to confirm your registration. This confirmation is necessary so that nobody can register with foreign e-mail addresses.

The newsletter registrations are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes the storage of both the registration and confirmation time as well as the IP address. Changes to your stored data are also logged.

Use of the dispatch service provider “mailchimp

The newsletters are sent via “Mailchimp” – The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA (https://mailchimp.com/contact/). The e-mail addresses of our newsletter recipients as well as their other data described in this notice are stored on the servers of Mailchimp, USA. The Rocket Science Group and the tool Mailchimp use this information to send and evaluate the newsletter on our behalf. Furthermore Mailchimp can use this data according to its own information to optimize or improve its own services, for example to technically optimize the sending and the presentation of the newsletters or for economic purposes to determine from which countries the recipients come. However, Mailchimp does not use the data of our newsletter recipients to write to them itself or pass them on to third parties.

We trust in the reliability and the IT- and data security of Mailchimp.
Mailchimp declares to comply with the EU data protection regulations according to the DSGVO as of May 25th, 2018 and therefore works together with a company from the UK for consulting. The
Privacy policy of Mailchimp can be viewed here: https://mailchimp.com/about/security/

Registration data

To subscribe to the newsletter we need your e-mail address and your first and last name as well as the form of address. This information is only used for
Personalization of the newsletter.

Statistical survey and analyses

The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file, which is downloaded from the CleverReach server when opening the newsletter
is retrieved. Within the framework of this retrieval, technical information such as information on the browser and your system, as well as your IP address and
time of the retrieval. This information is used for technical improvement of the services based on the technical data or the target groups and
of their reading behaviour on the basis of their retrieval locations (which can be determined by means of the IP address) or access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked
will be. For technical reasons, this information can be assigned to the individual newsletter recipients, but it is neither our intention nor our intention to
nor that of CleverReach to observe individual users. The evaluations rather serve us to evaluate the information and offers in our newsletter
to be better aligned with the individual interests of the respective recipient. The web beacon is deleted when you delete the newsletter.

To prevent the web beacon from being used in our newsletter, please set your mail program
so that HTML is not displayed in messages. The following pages explain how to use this setting for the most common
e-mail programs:

Microsoft Outlook
Mail for Mac (“Load removed content into messages”)

Online access and data management

There are cases where we direct the newsletter recipients to the websites of Mailcimp. For example our newsletters contain a link, with which the
Newsletter recipients can retrieve the newsletter online (e.g. in case of display problems in the e-mail program). Furthermore, newsletter recipients can
subsequently correct their data, such as their e-mail address. Likewise, the CleverReach privacy policy is only available on their site

In this context, we would like to point out that cookies are used on the websites of Mailchimp and thus personal data is stored by CleverReach, whose
partners and service providers (e.g. Google Analytics) are processed. We have no influence on this data collection. You can find further information in the privacy policy of Mailcimp.

We would like to point out that you have the right to object to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and
http://www.youronlinechoices.com/ (for the European Area).
